Terms of Service

These Terms of Service ('Terms') govern your use of PlotPacer, a self-build project management platform operated by Michael Maloney ('we', 'us', 'our') at plotpacer.ie (the 'Service').

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PlotPacer is a SaaS platform for Irish residential self-build project management. It provides tools for task scheduling, budget tracking, drawdown management, document storage, timeline visualisation, and cost estimation.

The Service is provided on an 'as is' basis. We make no guarantees that the information, templates, or tools provided are suitable for your specific project, comply with any particular regulations, or substitute for professional advice.

2. Accounts

• You must be at least 18 years old to create an account
• You must provide accurate information when registering
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• One account per person. You may not share accounts or create accounts on behalf of others without their consent

3. Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial.

At the end of the trial period, access to the Service will be restricted until you subscribe. Your data is retained for 30 days after trial expiry. We are not liable for any loss resulting from your failure to subscribe before data retention ends.

4. Subscriptions and Payment

4.1 Plans

PlotPacer offers the following subscription plans:

• Solo — €14.99/month: one active project, full feature access
• Contractor — €29.99/month: unlimited projects, full feature access

4.2 Billing

Subscriptions are billed monthly. Payment is processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis until you cancel.

4.3 Cancellation

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months.

4.4 Price changes

We may change subscription prices with 30 days' notice to existing subscribers by email. Continued use of the Service after a price change constitutes acceptance of the new price.

5. Your Data

You retain ownership of all project data you enter into PlotPacer. By using the Service, you grant us a limited licence to store and process your data solely for the purpose of providing the Service.

We do not sell, share, or use your project data for any purpose other than operating the Service. See our Privacy Policy for full details.

On account deletion or after the data retention period following cancellation, your data is permanently deleted and cannot be recovered.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or another user's account
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to store or transmit malicious code
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell or sublicence access to the Service without our written permission

7. Professional Advice Disclaimer

PlotPacer provides project management tools and informational content. Nothing in the Service constitutes legal, financial, architectural, structural, or construction advice.

Cost estimates, task templates, and scheduling guidance are provided for general planning purposes only. They do not account for your specific site, project, or regulatory requirements. Always consult qualified professionals — including your assigned certifier, structural engineer, and solicitor — for advice specific to your project.

Compliance with Irish building regulations (including BC(A)R), planning conditions, and all other legal requirements is your responsibility.

8. Intellectual Property

PlotPacer, its design, software, task templates, and content are owned by Michael Maloney and protected by Irish and EU intellectual property law. You may not copy, reproduce, or distribute any part of the Service without our written permission.

You retain full ownership of the project data and documents you create or upload.

9. Availability and Downtime

We aim to keep PlotPacer available at all times but do not guarantee uninterrupted access. We may take the Service offline for maintenance, updates, or circumstances beyond our control. We are not liable for any loss arising from Service unavailability.

10. Limitation of Liability

To the maximum extent permitted by Irish law:

• We are not liable for any indirect, incidental, or consequential loss arising from your use of the Service
• Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for loss of data resulting from your failure to maintain backups or your cancellation of an account

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Irish law.

11. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we reasonably believe your use of the Service creates risk for us or other users. We will notify you by email where possible before termination.

You may delete your account at any time by contacting hello@plotpacer.ie. Account deletion is permanent.

12. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Service are subject to the exclusive jurisdiction of the Irish courts.

If you are a consumer within the EU, you may also have rights under EU consumer protection law that cannot be excluded by these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
